Terms of Service

These Terms of Service ("Terms") govern your use of Plum, the personal AI agent service operated by Plum Applications, Inc. ("Plum," "we," "us"). By creating an agent or otherwise using the service, you agree to these Terms.

1. The service

Plum lets you create AI assistant agents that communicate by email (and, where enabled, text message), maintain a memory, and optionally access third-party services you connect, such as your calendar. Agents act automatically on messages from you and from contacts you approve.

2. Your account

Accounts are identified by email address and authenticated by sign-in links sent to that address. You are responsible for maintaining control of your email account and for activity that occurs under your Plum account. You must be at least 18 years old, or the age of majority where you live, to use the service.

3. AI-generated content

Your agent's responses are generated by artificial intelligence. They can be incomplete, outdated, or wrong, and they are not professional advice of any kind - legal, medical, financial, or otherwise. You are responsible for reviewing anything your agent does or says before relying on it, including messages it sends and calendar events it creates on your behalf.

4. Acceptable use

You agree not to use the service to:

• send spam, unsolicited bulk messages, or deceptive communications;
• impersonate any person or entity, or misrepresent an agent as a human where that matters;
• violate any law, or the rights (including intellectual-property rights) of others;
• attempt to breach, probe, or overload the service or its safeguards;
• create agents whose names infringe trademarks or are abusive or misleading.

We may suspend or remove agents or accounts that violate these rules.

5. Connected services

If you connect a third-party service (for example, Google Calendar), you authorize Plum to access it on your agent's behalf within the permissions you choose. Your use of those services remains governed by their own terms. You can disconnect them at any time.

6. Text messaging program

If you enable texting, you consent to receive recurring conversational messages, reminders, and notifications from your agent at the mobile number you registered. Consent is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel and stop receiving messages; reply HELP for help or contact support@plum-app.com. Mobile numbers and SMS opt-in consent are never shared with third parties or affiliates for marketing or promotional purposes - see the Privacy Policy. Carriers are not liable for delayed or undelivered messages.

7. Fees

The service is currently offered without charge. We may introduce paid plans in the future; if we do, we will tell you before anything you use starts costing money.

8. Your content

You retain ownership of the content you send to your agents and the memory and skill files your agents build for you. You grant us the limited license needed to operate the service - to store, process, and transmit that content in order to provide it. We do not use your content to train AI models. 9. Termination

You may stop using the service at any time and may request deletion of your account and its data by emailing support@plum-app.com. We may suspend or terminate the service or your access to it for violation of these Terms, or discontinue the service with reasonable notice.

10. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that agent output will be accurate.

11. Limitation of liability

To the maximum extent permitted by law, Plum Applications, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim arose.

12. Changes

We may update these Terms from time to time. Material changes will be announced on this page with an updated date, and where practical, by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.
